The promoter is SXSW Sydney (ABN 13 661 937 980) of Level 3, 175 Liverpool Street, Sydney NSW 2000 (Promoter).
This promotion is conducted in connection with the online sale of tickets by the Promoter to SXSW Sydney 2025 (Event).
Entry is only open to residents of Australia who meet any minimum age restriction advertised for the Event and are authorised to purchase ticket(s) to the Event (Entrants).
If individuals aged under 18 years are permitted to enter the promotion, these individuals must have the consent of their parent or legal guardian to enter the promotion and their parent or legal guardian must read and consent to these Terms and Conditions and may be required by the Promoter to enter into a further agreement as evidence of consent.
The directors, management and employees (and their immediate families) of the Promoter and its agencies directly associated with this promotion are ineligible to enter. “Immediate family” means any of the following: spouse, ex-spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
This promotion commences at 9:00 am (Sydney time) on Monday 20 October 2025 and closes at 11:59 pm (Sydney time) on Sunday 2 November 2025 (Promotional Period).
To receive a valid entry into the Promotion, Entrants must, during the Promotional Period: (a) complete the Post Festival Survey accessible at https://culturecounts.cc/s/sxswsydney-25 (Promotional Website); and (b) elect to enter the competition and provide their name and email address when prompted on the Promotional Website (Eligible Activity).
A valid completion of the Eligible Activity is one (1) entry into the Promotion. Each Entrant may only enter once during the Promotional Period.
Entries must be received by the Promoter during the Promotional Period. Entries will be deemed accepted at the time of receipt and not the time of transmission. Incomplete, indecipherable or illegible entries will be deemed invalid.
Any costs associated with accessing the Promotional Website to enter the promotion are the Entrant’s responsibility and depend on the Internet service provider used.
The use of any automated entry software or other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
All Entrants who complete an Eligible Activity during the Promotional Period will be automatically entered into the draw. The draw will take place at 10:00 am (Sydney time) on Tuesday 4 November 2025 at the Promoter’s premises. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner(s) will be notified in writing by no later than Friday 7 November 2025. Any winner(s) of prize(s) valued at over $500 will be published on the Promotional Website within two (2) days of the draw and will remain on the site for at least 28 days. The Promoter’s decision is final and no correspondence will be entered into.
From all valid entries, the Promoter will select a winner at random. The winner(s) will receive a Visa gift card valued at $1,000. The Promoter’s decision is final and binding.
If a winner is under 18 years of age, the prize will be awarded to the winner’s nominated parent or guardian on their behalf.
The prize(s) are subject to their prevailing terms and conditions as advised by the Promoter and/or any applicable prize supplier.
Subject to the unclaimed-prize clause, if for any reason any winner does not take and/or participate in the prize (or any part of it) at or by the time stipulated by the Promoter, then the prize (or that component) will be forfeited.
All costs not expressly stated, but which may be incurred in accepting or participating in the prize(s), are the responsibility of the winner(s).
If the prize(s) include voucher(s) or card(s), any ancillary costs associated with redeeming them are not included unless expressly stated. Unused balances will not be awarded as cash. Redemption is subject to issuer terms and conditions, including expiry dates.
The Promoter and any prize suppliers reserve the right to require the winner(s) (and companion(s)) to provide proof of identity, including photo ID, before issuing the prize. If a winner is under 18, their companion (or one of them) must be the consenting parent or guardian.
Total maximum prize value is AU$1,000. The prize(s), or any unused portion, are not transferable or exchangeable and cannot be taken as cash unless otherwise specified.
A draw for any unclaimed prize(s) will not be conducted. Any unclaimed prizes will be forfeited. The Promoter’s decision is final.
The Promoter reserves the right to verify the validity of entries and Entrants and to disqualify anyone who breaches these Terms and Conditions, tampers with the entry process, or engages in misconduct. Errors and omissions may be accepted at the Promoter’s discretion.
In the event of a dispute over identity, the winner will be deemed to be the individual who completed the Eligible Activity via the Promotional Website.
As a condition of entering, Entrants consent to the Promoter using their name, likeness, image and/or voice if they win, in any media for an unlimited period without remuneration, for promotional purposes.
If a prize (or part of it) is unavailable, the Promoter may substitute it with one of equal or greater value, subject to any written directions from a regulatory authority.
If this promotion is interfered with or cannot be conducted as anticipated due to reasons beyond the Promoter’s control (e.g. technical difficulties, unauthorised intervention, fraud), the Promoter may disqualify entries or modify, suspend, terminate or cancel the promotion as appropriate.
Nothing in these Terms and Conditions limits or modifies the statutory consumer guarantees under the Competition and Consumer Act 2010 (Cth) or similar laws (Non-Excludable Guarantees). Except for any liability that cannot be excluded, the Promoter excludes all liability (including negligence) for any personal injury or loss or damage arising in any way out of the promotion.
Except for liability that cannot be excluded, the Promoter is not responsible for any: (a) technical difficulties or equipment malfunction; (b) theft, unauthorised access or third-party interference; (c) late, lost, altered, damaged or misdirected entries; (d) variation in prize value; (e) tax liability incurred by a winner or Entrant; (f) delay, postponement or cancellation of the Event or prize event; or (g) use of or participation in the prize(s).
The Promoter collects personal information (PI) to conduct the promotion and may disclose it to related entities, agents, contractors, service providers, prize suppliers, and regulatory authorities. Entry is conditional on providing this PI. The Promoter’s Privacy Policy is available at https://www.sxswsydney.com/privacy-policy and explains how entrants can access, update or correct their PI, opt out, and make complaints.
